By using the Music Choice Site You agree to be bound by the terms and conditions set out below. If You do not wish to be bound by these terms and conditions, You should not use the Music Choice Site.

Neither, Music Choice, its affiliates, its licensors or any third-party content provider makes any warranty whatsoever, including without limitation:

• That the operation of the Site will be uninterrupted or error-free;
• The defects will be corrected;
• That the Site, including the server that makes it available, is free of viruses or other harmful components;
• As to the results that may be obtained from use of the materials on the Site; or as to the accuracy, reliability, availability, suitability, quality, or operation of any information, software, or service provided on or accessible from the Site.

Neither, Music Choice, its licensors, affiliates or third party content providers shall have any liability to you in relation to any loss or damage that you suffer as a result of any delay or defect in or failure of the whole or any part of (or any combination of):

Neither Music Choice nor its affiliates nor third party content providers shall have any liability to you (whether in contract or in tort), including negligence) in the event that:

• The Site includes inaccuracies or typographical errors.

You will ensure that no computer viruses, worms, software bombs or similar items are introduced into the Site and will indemnify Music Choice (in accordance with the "Indemnity" paragraph below) for any loss that Music Choice suffers arising as a result of any such introduction.

You shall indemnify, protect and hold Music Choice harmless from and against all losses, liabilities, judgments, suits, actions, proceedings, claims, damages and costs resulting from or arising out of any breach of these Terms of Use and/or act or omission by any person (which includes Authorised Personnel - whether or not such Authorised Personnel is employed by or contracted to you at the time of such act or omission) obtaining access to the Material (including restricted Material) on the Site by using your designated password, whether or not you authorised such access.

Parts of this site are intended for the provision of photographic or other images and online material (including Music Choice trademarks and logos ("the Material") provided by Music Choice, its licensors and third party content providers. All materials in the Site (including without limitation any site layout, design, text, images, graphics, audio and audio-visual content) are the property of Music Choice, its licensors, or third parties and are subject to copyright protection. You may not publish, copy, display, reproduce, upload, distribute, transmit, perform, modify, create derivative works from, or sell any information, products or services obtained from the Site, except as described in these Terms of Use or as otherwise expressly permitted by us.

You acknowledge that Music Choice does not own certain Materials on the Site. Music Choice may specify on the Site whether and how such Materials can be used. You agree to abide by such specifications.

The Music Choice trademarks and logos that appear throughout the Site belong to Music Choice or to third party trademark owners. Except as permitted by applicable laws, you are prohibited from using any of the trademarks appearing on the Site without express written consent from Music Choice or the third party trademark owners.

Certain sections of the site (including but not limited to photos and logos) are restricted by Music Choice. You will be able to access or download Material in these restricted sections by entering an e-mail and password if authorised by Music Choice. Any person granted access to the restricted areas of the site by Music Choice is referred to below as "Authorised Personnel".

Music Choice has the right to suspend or withdraw temporarily or permanently your access to the restricted Materials at any time for any reason including but not limited to:

• You are in breach of these Terms of Use; or
• You (being a limited company) make any assignment for the benefit of creditors or make any compositions with creditors or if any action or proceeding under any insolvency law is taken against you and is not dismissed or if you shall effect a voluntary or compulsory liquidation of assets; or
• You (being an individual) are made bankrupt or convicted of a criminal offence involving fraud or theft; or
• Music Choice is unable to provide access to the Site due to a defect in or failure of network, communication or computer systems owned or operated by Music Choice or any third party.

Provided you keep intact all copyright and other proprietary notices, you may print or download content and Materials on the Site (but not audio and audio-visual content) for your use ONLY in the normal course of your business which for the purpose of this licence will be limited to raising awareness of and/or promoting the Music Choice programme in the affiliate publication and on your website.

You must not:

• Allow any third parties to use the Materials without prior written consent from Music Choice;
• Engage in systematic retrieval of data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database or directly mirror on your own site, pages taken from the Site;
• Use the Materials on the Site for any purpose not expressly permitted in these Terms of Use;
• Use the Materials to promote programmes other than Music Choice;
• Alter the photographic images or any material in any way whatsoever;
• Make the Material available for down-loads;
• Promote or use the Material on a personal fan site.

In the event you download in the course of your business for the purposes set out in this Licence any Material from Site, such Material is sub-licensed to you by Music Choice. Music Choice does not transfer title to the Material to you. Music Choice and its Licensors reserve all rights not specifically granted to you.

These Terms of Use shall operate and be governed by and interpreted in accordance with the laws of England and the High Court of Justice shall be the court of exclusive jurisdiction. If any provision of these Terms of Use shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions. These Terms of Use represent the entire agreement between you and Music Choice relating to the subject matter herein and shall not be modified except in writing, signed by both parties.

1. Unless otherwise stated, no purchase necessary.
2. Competitions are only open to residents of the UK aged 18 or over excluding employees and their families of Music Choice, and anyone involved in the administration of any competition.
3. All instructions and any specific rules relating to any competition form part of the Terms and Conditions.
4. The judges’ decision is final and no correspondence will be entered into. Details of the judges and any correct answers may be obtained by sending a stamped, self-addressed envelope to Music Choice after the date of judging.
5. Unless otherwise stated, each competition is managed by Music Choice Limited of The Old Truman Brewery, 91 Brick Lane, London E1 6QL.
6. All entries and copyright in them will become the property of Music Choice on sending and will not be returned.
7. Music Choice reserves the right to change or withdraw a competition at any time and will endeavour to give advance notice of any change or withdrawal. However, in some cases advance notice may not be possible.
8. Prizes are as stated, and, unless otherwise stated, are non-transferable and no cash alternative will be offered.
9. No entry will be accepted after the stated closing date for any reason.
10. Proof of sending will not be accepted as proof that Music Choice has received your entry and no responsibility will be accepted for entries which are lost, delayed, damaged or otherwise fail to reach Music Choice.
11. Winners will be notified by post or email within 28 days.
12. Winners agree that their name may be used in future publicity material and they agree to take part in any future promotional activity.
13. Upon entry, entrants will have provided their personal data to Music Choice and consent to use of their data in connection with the competition and purposes of advising entrants of other competitions, and new products and services, and for future market and quality control analysis. Entrants have the right to consult, and request rectification of their information as held by Music Choice and withdraw their consent to use of their data. 14. To obtain details of the prize winners please write, enclosing a stamped, self addressed envelope, to Music Choice at the above address.
15. By entering all entrants agree to abide by the rules of the competition which include all instructions and these terms and conditions.
